Last month at the International Business Law Services (IBLS) Strategic Global Summit for E-Commerce, Pauline Reich, an associate professor at Waseda University School of Law in Tokyo, Japan, gave a speech entitled "Legal Issues: Internet and E-mail in the Workplace." Reich is also a well-known expert in the areas of cyberlaw and Internet-based legal, business and government research. During her talk, Reich explored the worldwide evolution of procedures governing Internet use in the workplace and discussed the factors managers need to consider when instituting an Internet and e-mail policy. She emphasized that establishing such a policy is essential and that setting forth guidelines for everyone -- including on-site employees, telecommuters, temps, consultants and independent contractors -- can avert a host of disasters, from basic liability to leaks of company secrets. The more a company knows about its customers, the easier it is to reach out and touch them. Now though, governments across Europe are under pressure to develop legislation in response to the growing consensus that businesses should be made accountable for how personal information is stored, used and distributed. Consequently, a raft of new laws have emerged which codify privacy rights for the digital age. The Data Protection Act (DPA) and the Regulation of Investigatory Powers Act (RIPA) are, in the United Kingdom, the first in this new wave of 'cyberlaws' - legislation designed to reinforce privacy rights threatened by the unregulated dissemination of information, in a world where everything from birth records to shopping habits are stored electronically. Much of the thinking behind cyberlaw is so new however, that the majority of companies are unaware it even exists, let alone realize they must now comply. And yet, unless business leaders take formal action to protect the integrity of their data, it could become a major threat rather than an important asset. Granick is now defending Jerome Heckenkamp, the 21-year-old Los Alamos National Laboratory employee accused of breaking into eBay's computer systems. A frequent speaker at the annual Def Con hacker conference, Granick was appointed last month to head Stanford University Law School's new Center for Internet and Society, a legal institute that will train students in Internet law.
