FCC Claims Unprecedented Broadband Growth Amid Controversial Policies

The FCC this week proclaimed that broadband connectivity saw unprecedented growth last year thanks to agency policies like killing net neutrality. The problem? That doesn’t appear to be true. . U.S. Court Ruling on FCC’s Net Neutrality Authority and Broadband Control

On Tuesday in Washington, DC, the U.S. Court of Appeals for the District of Columbia ruled that the FCC lacks authority to require broadband providers to give equal treatment to all Internet traffic flowing over their networks.. This begs two questions. First, if not the FCC, then who has that authority? The second, bigger question is what does this do for the issue of Net Neutrality in the United States? The decision was a victory for cable provider Comcast who has been accused of traffic shaping on its network. Comcast argues, perhaps correctly, that since they built the network and since they manage the network, they are in the right when it comes to what traffic can and cannot cross their network. On the other side are users and companies, like Google, that feel that the pipes, regardless of who owns them, should be open and available to whomever wants to use them. And therein is the rub. Third party providers of services such as VoIP have long complained that Comcast has been throttling their packets, resulting in a lower quality of service, while Comcast gave a higher QoS its own packets. This is all well and good if you are trying to keep a competing product out (or so the mantra of capitalism would go) but it causes issues when you are communicating between systems, or, as Google has argued in the past, when the route from Point A to Point E goes across the network of Point C. U.S. House Vote Result: Net Neutrality Rejection by 269-152

The U.S. House of Representatives definitively rejected the concept of Net neutrality on Thursday, dealing a bitter blow to Internet companies like Amazon.com, eBay and Google that had engaged in a last-minute lobbying campaign to support it. . By a 269-152 vote that fell largely along party lines, the House Republican leadership mustered enough votes to reject a Democrat-backed amendment that would have enshrined stiff Net neutrality regulations into federal law and prevented broadband providers from treating some Internet sites differently from others. Of the 421 House members who participated in the vote that took place around 6:30 p.m. PT, the vast majority of Net neutrality supporters were Democrats. The Federal Communications Commission (FCC) has asked the Supreme Court to hear an appeal that could determine whether cable broadband providers can be forced to open their networks to other Internet providers. The request, which FCC Chairman Michael Powell announced Monday, was hailed by some industry groups and slammed by some consumer watchdog organizations, who had hoped that an earlier appeals court decision would clear the way for more robust competition and increased choice for consumers. If the ruling is overturned and the FCC is allowed to lift regulations on broadband providers, third-party ISPs such as America Online and EarthLink (Nasdaq: ELNK) could find themselves shut out of many cable markets where they don't already have access agreements in place. Representatives of the FBI's Electronic Surveillance Technology Section in Chantilly, Va., have met at least twice in the past three weeks with senior officials of the Federal Communications Commission to lobby for proposed new Internet eavesdropping rules. The FBI-drafted plan seeks to force broadband providers to provide more efficient, standardized surveillance facilities and could substantially change the way that cable modem and DSL (digital subscriber line) companies operate. The new rules are necessary, because terrorists could otherwise frustrate legitimate wiretaps by placing phone calls over the Internet, warns a summary of a July 10 meeting with the FCC that the FBI prepared. "Broadband networks may ultimately replace narrowband networks," the summary says. The FBI and Justice Department are worried that Voice Over IP (VoIP) applications may become safe havens for criminals to communicate with one another, unless U.S. regulators make broadband services more vulnerable to lawful electronic eavesdropping, according to comments filed with the FCC this month. The government filing was prompted by the efforts of telecom entrepreneur Jeffrey Pulver to win a ruling that his growing peer-to-peer Internet telephony service Free World Dialup is not subject to the regulations that govern telephone companies. Free World Dialup has been called "Napster for Phones." It's a free service aimed at developing Internet telephony as a mainstream alternative to the public switched telephone network. After an initial investment of about $250 for a Cisco SIP telephone -- a device that functions much like a conventional analog phone, but plugs directly into an IP network -- users can "dial" each other over the Internet anywhere in the world at no cost. Free World Dialup provides a directory service that assigns each user a virtual telephone number, and sets up each phone call.
