In early August, officials at America Online released information about searches being conducted by AOL members and users of the AOL search tool. This historical data was released onto the Internet by several AOL officials, to demonstrate how useful such data could be for tracking patterns, uses and interest of AOL members. Optimum Choice, a cable Internet service provider (ISP) operated by New York-based Cablevision, confirmed Thursday that a federal judge has ordered the company to turn over information about its customers to federal authorities without alerting the customers that their information is being sought. Although Cablevision sources confirmed the decision, they declined to comment on the case until Monday, when the judge in the case is expected to publish his verdict. The case is the latest example of the "continuing issues that come up because of convergence," Bob Corn-Revere, an attorney at Washington law firm Hogan & Hartson who follows ISP litigation, said today. At issue is whether the privacy practices of cable ISPs are governed by the Cable Act of 1984 or the Electronic Communications Privacy Act (ECPA) of 1986. The Cable Act, which governs all U.S. cable companies, says that a company cannot disclose information about its customers -- even if that information subpoenaed by law enforcers -- without notifying the customers first. The FBI released the first documents about its controversial Carnivore email surveillance software on Tuesday, but more than half of the 750 pages were blacked out and hundreds more were withheld. The Electronic Privacy Information Centre (EPIC) filed suit in June under the Freedom of Information Act seeking the release of the Carnivore source code, other technical details and legal arguments addressing the potential privacy implications of the technology. The lack of information contained in the documents, while disappointing, was not unexpected, said David Banisar, staff counsel for EPIC. "Of the pages that they withheld in full, about 160 were source code pages for Omnivore." The link for this article located at ZDNet is no longer available. .
