FCC Delays Vote on Net Neutrality Until December 21, 2023

After more than five years of hemming and hawing, the FCC appears close to voting on net neutrality, the hotly contested means of overseeing Internet access. The FCC has postponed its Dec. 2 meeting to Dec. 21, prompting speculation the agency is getting its ducks in a row for a vote on the politically polarized issue. . The US Supreme Court wrapped up its session by announcing a decision which bars the enforcement of the Child Online Protection Act (COPA). The COPA, passed in 1998, was an attempt by Congress to keep pornography out of the reach of children on the Internet by requiring credit cards, access codes, or other means of age verification to access adult content, with fines of up to US$50,000 for violations. . . .. A tough new bill to combat spam was signed into law Tuesday in Virginia. While about half of the states in the U.S. do have anti-spam laws, the Virginia law - which provides for fines and jail time - is a first in that it allows authorities to seize the assets earned from spamming. The penalties can apply even if the sender and recipients live elsewhere because much of the global Internet traffic passes through northern Virginia, home to major online companies such as America Online and MCI and a conduit to major federal communications hubs in neighboring Washington and its suburbs. In the wake of the Sept. 11 terrorist attacks, the Canadian government hurriedly introduced a series of new anti-terror measures. Quietly included was a seemingly innocuous announcement -- Canada, alongside other countries such as the United States, would implement the global cybercrime treaty developed by the Council of Europe. The full impact of that decision began to take shape last month when Ottawa released a discussion document outlining the changes required to bring Canadian law into conformity with the treaty. The document, titled Lawful Access, details significant changes in the surveillance practices of Internet service providers (ISP) and in law enforcement's access to computer data. The proposal is troubling not only for what it says, but even more so for what it doesn't say. The Lawful Access document covers four main issues. First, ISPs will be required to install surveillance systems on their networks to allow for interception capabilities. If implemented, the law would ensure that ISPs could provide authorities with access to all communications over their networks including the content of messages and details about data traffic. While the proposal recognizes that this entails a significant new cost for ISPs, it leaves open the question of who should pay for it. Developed by the World Wide Web Consortium (W3C), P3P is a specification that standardizes privacy policy generation and enables browsers and plug-ins to translate sites' policies into point-and-click user interfaces. At its most basic level, P3P is a standardized set of multiple-choice questions covering all the major aspects of a Web site's privacy policies. Taken together, they present a clear snapshot of how a site handles personal information about its users. P3P-enabled Web sites make this information available in a standard, machine-readable format. P3P-enabled browsers can read this snapshot automatically and compare it to the consumer's own set of privacy preferences. If a site violates those preferences, the browser can issue alerts or even block sites that don't conform. "What makes P3P so good is that it empowers users to make choices on the information collected," says Josh Freed, director of privacy technology for Washington, D.C.-based Internet Education Foundation. Because of the power it gives consumers, it will force sites not only to P3P-enable their privacy policies, but also to improve the policies they have, he adds.
