The defendants (including UK-based Spamhaus Project and SPEWS) hope to cover their costs through online donations, but their legal bill has tempered some of the pleasure gained from giving litigious penis pill pushers a legal "bloody nose". In a message to the NANAE newsgroup last week, Spamhaus director Steve Linford sums up his feelings: "Although delighted with the technical outcome, we're left with the costs of having had to defend the bogus lawsuit, as the Florida legal system does not grant costs to the winner even in cases where lawsuits are as fraudulent as this one clearly was." Verizon turned over the names after an appeals court denied the company's request for a stay to challenge a law that allows the music industry to subpoena such information. The U.S. Court of Appeals for the District of Columbia ruled on Wednesday. Verizon filed the appeal after a U.S. district judge ordered the ISP to turn over the names of two Verizon customers who had allegedly downloaded hundreds of songs through a peer-to-peer file-swapping service. An RIAA spokesperson says the industry group is weighing its options on what do with the names of the alleged downloaders. "In the next several days, we will evaluate how this ruling can best be incorporated into our overall enforcement program," the representative says. The case of Russian programmer Dmitry Sklyarov, charged with violating copyright law by writing software that strips copy and use restrictions out of Adobe Systems e-books, will be heard in March 2002. The US District Court will hear Sklyarov's appeal against his indictment on the issue of US jurisdiction over the case, and another appeal that challenges the constitutionality of the 1998 Digital Millennium Copyright Act (DMCA), under which Sklyarov was originally charged. Sklyarov, a Russian citizen, was arrested in July at the end of the Def Con hacker conference in Las Vegas, where he had given a presentation on e-book security. He was charged with violating the DMCA, which makes it a crime to traffic in tools or information designed to circumvent copy control schemes for encrypted content. And even the castigated 2600 Hacker Quarterly has gotten around the no-linking decision by simply removing the HTML and carrying a text list of more than 200 URLs you can cut and paste into a browser to reach a site that does post DeCSS.
