Huawei's Legal Battle Against NDAA Section 889 Unconstitutionality

Huawei has filed a motion for a summary judgment against the US government that alleges section 889 of the National Defense Authorization Act 2019 (NDAA) is unconstitutional. . In the motion, Huawei argues that section 889 specifically targets Huawei, saying the legislation disrupts the company's existing contracts; stigmatises the company and its employees as supposed tools of the Chinese government; and seriously threatens the company's ability to do business in the US. EU Court To Hear Privacy Shield Challenge By Digital Rights Group July 1-2

A legal challenge to the EU-US Privacy Shield, a mechanism used by thousands of companies to authorize data transfers from the European Union to the US, will be heard by Europe’s top court this summer. . The General Court of the EU has set a date of July 1 and 2 to hear the complaint brought by French digital rights group, La Quadrature du Net, against the European Commission’s renegotiated data transfer agreement which argues the arrangement is still incompatible with EU law on account of US government mass surveillance practices. Privacy Shield was only adopted three years ago after its forerunner, Safe Harbor, was struck down by the European Court of Justice in 2015 following the 2013 exposé of US intelligence agencies’ access to personal data, revealed by NSA whistleblower Edward Snowden. Supreme Court's 5-4 Decision on Warrantless Surveillance Challenge

A divided Supreme Court halted a legal challenge Tuesday to a once-secret warrantless surveillance project that gobbles up Americans. The 5-4 decision (.pdf) by Justice Samuel Alito was a clear victory for the President Barack Obama administration, which like its predecessor, argued that government wiretapping laws cannot be challenged in court. Supreme Court Hearing on Warrantless Surveillance Program Although Secret

The Supreme Court on Monday will hear arguments on whether it should halt a legal challenge to a once-secret warrantless surveillance program targeting Americans. Bush administration in the wake of the September 11, 2001 terror attacks, and largely codified into law years later. The link for this article located at Wired is no longer available. . Rocky Mountain Bank Legal Challenge: Data Leak of Customer Info

A US bank is suing Google for the identity of a Gmail user after a bank employee accidentally sent the user a file that included the names, addresses, tax IDs, and loan info for more than 1,300 of the bank's customers.. In mid-August, according to court documents filed in a California federal court, the Wyoming-based Rocky Mountain Bank was asked by a customer to send certain loan documents to a Gmail account belonging to a third party. A bank employee attempted to do so. But a day later, he realized he had sent the documents to the wrong address - along with a file containing confidential information for 1,325 other customers. After a failed attempt to recall the email, the employee sent a second note to that wrong address, requesting that the confidential email be deleted before it was opened. There was no response, so the bank contacted Google to determine what could be done to ensure that the confidential info remained confidential. According to the court papers, Google would not provide information on the account unless it received a subpoena or "other appropriate legal process." A pair of students were blocked by a federal court from presenting information at a Georgia security and hackers' conference on how to break into and modify a university electronic transactions system. Washington D.C.-based education software company Blackboard successfully convinced a Georgia state court to block the students' presentation, which was scheduled to be given at the Interz0ne conference in Atlanta last weekend. Blackboard argues that the restraining order blocked the publication of information gained illegally, which would have harmed the company's commercial interests and those of its clients. But conference organizers contend that the students' free speech rights were abridged. The link for this article located at news.com is no longer available. . Gray Davis' proposal to let state and local police obtain roving wiretaps on suspected criminals was dropped from the legislation containing it Tuesday after the legislative counsel's office concluded that it was illegal. The proposal, a centerpiece of Davis' State of the State address last week, had been welcomed by some law enforcement leaders but criticized by civil libertarians and some liberals. Davis unveiled the idea at the outset of a reelection bid in which he faces challenges from three Republicans--former Los Angeles Mayor Richard Riordan, Secretary of State Bill Jones and investor Bill Simon Jr.--each vying for the GOP nomination to take on the Democratic incumbent.
