Britain's Internet Law: Preventing Illegal File Sharing and Disconnection

Britain is to push ahead with a law to clamp down on illegal file sharing, that would start with a series of warning letters and could result in repeat offenders losing their Internet connection.. The proposals, which were set out by Business Secretary Peter Mandelson, have followed a high-profile campaign from artists such as Lily Allen and James Blunt, and follow France's move to ban illegal peer-to-peer sharers for up to a year. The rules could disappoint some of the artists and executives who have campaigned for the law, however, as the government does not plan to introduce the disconnection element of the law for at least a year, once the bill has passed. Sen. Maria Cantwell, D-Wash.; Les Vadasz, president of Intel Capital; Mitch Kapor, chairman of the Open Source Applications Foundation; and Hilary Rosen, CEO of the Recording Industry Association of America, engaged in a lively, sometimes heated, debate on recently proposed government controls on digital media devices. They met Sunday in an opening panel discussion at PC Forum, an annual technology conference hosted by author and technology pundit Esther Dyson. The debate comes days after Sen. Ernest "Fritz" Hollings introduced a bill that would ultimately require computer and consumer electronics companies to build piracy-prevention software into their products. In the wake of DeCSS, the decryption technology for DVD, the Digital Versatile Disc industry has been searching for well over a year for new ways to thwart DVD piracy. But in much the same way the industry stepped on its own toes throughout the long, delayed struggle to release the DVD format itself, competing companies with conflicting interests are once again standing in the way of consensus. The industry agrees it cannot simply replace its existing copy-protection scheme, because that would invalidate the more than 13 million DVD players already sold. Instead, whatever new system the industry adopts cannot interfere with existing players, at the same time that support is slowly implemented into future hardware. "I would be surprised if there's any kind of robust scheme that wouldn't involve firmware," says Bill Hunt, editor of The Digital Bits, one of the first DVD fan sites. Nearly all of the music shared on the Internet through programs such as Napster comes from CDs, which can easily be copied, or "ripped," as MP3 files.
