Countries Reject U.S. Tactics on Copyright in New TPP Text

When we wrote about the intermediary liability provisions in a reported May 2015 leak of the Intellectual Property chapter of the Trans-Pacific Partnership (TPP) last month, we hadn't actually seen the text. But thanks to the publication of that leak by Knowledge Ecology International yesterday and today, we now have a far better understanding of the current state of play. For starters, countries are resisting U.S. negotiators' audacious proposal to distort trade secrets law into a weapon against hackers, journalists, and whistleblowers. There are two new proposals in this leaked text, one of which the U.S. itself supports, to allow countries to adopt a narrow safe harbor for whistleblowers in respect of information that exposes a violation of the law.. California Appeals Court Reverses DeCSS Ban: A Free Speech Victory

A California appeals court on Friday reversed a 4-year-old order barring the publication of a DVD-cracking tool on the Internet, finding the injunction violated the defendant's free speech rights. . . .. The case was closely watched as a test of how much protection companies can expect in California for trade secrets that become widely distributed online. The plaintiff, the DVD Copy Control Association, had argued that Andrew Bunner violated its intellectual property rights by posting on the Internet code known as DeCSS that can be used to bypass Hollywood's encryption scheme for DVDs. Bunner's attorneys had countered that the code was no longer a secret by the time he posted it on his Web site. On Friday, California's Sixth Circuit Court of Appeals agreed, reversing a trial judge's order first issued in 1999. "The preliminary injunction...burdens more speech than necessary to protect DVD CCA's property interest and was an unlawful prior restraint upon Bunner's right to free speech," the three-judge panel wrote in its decision. The California Supreme Court ruled Monday that a Web publisher could be barred from posting DVD-copying code online without infringing on his free speech rights. The state's high court overturned an earlier decision that said blocking Web publishers from posting the controversial piece of software called DeCSS, which can be used to help decrypt and copy DVDs, would violate their First Amendment rights. An industry technology coalition called the DVD Copy Control Association (DVD CCA) had sued dozens of people in California courts, contending that posting the software online violated its trade secrets rights. Monday's state Supreme Court decision did leave room for another legal about-face, asking a lower court to revisit the question of whether any industry trade secret rights actually were violated.
