Analyzing FCC's Net Neutrality Challenges Regarding Online Piracy

I must confess, I thought FCC Chairman Julius Genachowski had found a clever way to keep his bid for Net neutrality regulations from getting mired in the debate over online piracy. When the FCC agreed to start the rulemaking process in October, Genachowski made it clear that the regulations wouldn't apply only to the transmission of unlawful content. That's code for bootlegged copies of "Avatar" and "The Hangover.". And yet (he says, channeling Al Pacino as Michael Corleone), Genachowski can't help being pulled back into the issue. In their comments on the FCC's notice of proposed rulemaking, entertainment-industry groups argued that the rules at the very least shouldn't discourage Internet service providers from trying to stop pirated content. The RIAA urged the commission to go further: ISPs are in a unique position to limit online theft. They control the facilities over which infringement takes place and are singularly positioned to address it at the source. Without ISP participation, it is extremely difficult to develop an effective prevention approach. We thus urge the Commission to adopt rules that not only allow ISPs to address online theft, but actively encourage their efforts to do so. In a statement accompanying their joint filing, four entertainment-industry unions struck a similar note: As Guilds and Unions representing more than 300,000 workers in the entertainment and media industries, we urge the FCC to ensure that any policies laid forth to preserve a free and open Internet also strengthen the distinction between the lawful and unlawful transmission of Internet content. We encourage the FCC to take all appropriate steps to keep the Internet from becoming a haven for the theft and illegal transmission of motion picture, audiovisual and sound recording works. Penalties for violations include fines of up to US$250 per e-mail, capped at up to $6 million. The bill's authors, Montana Republican Senator Conrad Burns and Oregon Democrat Senator Ron Wyden, praised the legislation as a powerful tool for countering the spam onslaught cluttering inboxes. "Swift and aggressive enforcement will be essential, and Senator Burns and I will continue to push the Federal Trade Commission and others to use the tools this law gives them to fight against spam," Wyden said in a written statement. Several major ISPs (Internet service providers) and e-commerce companies lined up to endorse the legislation. US Cybercrime Treaty Insights: Privacy Rights and Surveillance Concerns

Even though the United States is a nonvoting member of the Council of Europe, it has pressed hard for the cybercrime treaty as a way to establish international criminal standards related to copyright infringement, online fraud, child pornography and network intrusions. . . . . The U.S. Department of Justice says the treaty will eliminate "procedural and jurisdictional obstacles that can delay or endanger international investigations." Civil libertarians have objected to the treaty ever since it became public in early 2000, arguing that it would endanger privacy rights and grant too much power to government investigators. So have industry groups such as Americans for Computer Privacy and the Internet Alliance. They raised concerns that the treaty could limit anonymity or impose vague record-keeping requirements on U.S. Internet providers. "It's a treaty that goes way beyond combating cybercrime," said Barry Steinhardt, director of the ACLU's technology and liberty program. "It would require nations that participate in the treaty to adopt all sorts of intrusive surveillance measures and cooperate with other nations, even when the act that's being investigated is not a crime in their home country." So far, according to the Council of Europe, only three countries--Albania, Croatia and Estonia--have ratified the treaty. If the Senate approves it, the Bush administration said it believes that because U.S. law already abides by provisions in the treaty, no further legal changes would be necessary. It's not a new argument: When the FTC voted 3-2 in May 2000 to ask Congress for more power to regulate Web sites, Swindle was one of the two dissenters. Appointed to the FTC by then-President Clinton in December 1997, Swindle previously worked as an assistant secretary in the Commerce Department under President Reagan. He was a Marine aviator in Vietnam, and his plane was shot down in 1966. Swindle, who spent the next six years in a prisoner of war camp, won two Purple Hearts during his combat service. The recent ruling by a Philadelphia court in response to a challenge by the American Library Association (ALA) and the American Civil Liberties Union (ACLU) to the Children's Internet Protection Act (CIPA) represents another setback for Congressional prudes and the filtering software lobby. Briefly, the CIPA would deny public funds to libraries which refuse to install expensive content-filtering software on their Net-connected computers, and the court ruled it unconstitutional. The ruling will undoubtedly influence further decisions regarding public access to Internet content which the government in its infinite wisdom reckons you're better off not encountering. The Philadelphia decision hinges on the means of enforcement, not the theoretical framework on which the CIPA is based. Surely it wouldn't be unconstitutional to block obscenity and kiddie porn which have no protection, so long as protected content isn't blocked. The question, then, is whether the means exist to satisfy Congress' insatiable appetite for regulating the pleasures of citizens without running afoul of the First Amendment. .
